"Duke" Addicks, Jr., Attorney, Pepin, Dayton, Herman, Graham & Getts, <br />339 -7633 <br />Donna McNeally, Planner, Dept. of Planning and Economic Development, City of St. <br />Paul, 292 - 1577,. ex. 323 <br />GENERAL ORDINANCE DESIGN CONSIDERATIONS <br />Determine the basic purpose of the ordinance: <br />. eliminate: the purpose of such would be to eliminate any existing, illegal <br />accessory apartments, and prevent any future conversions <br />. recommendation: don't bother with supplementary ordinance; clarify <br />and /or beef up existing regulations that 1) prohibit 2 units /structure <br />and 2) inspect and tag /fine for such when found <br />restrict: the purpose of such would be to reluctantly allow accessory <br />apartment conversions, commonly with the ordinance designed to make it <br />as difficult as possible to meet the new standards being recommended; <br />such standards might include rigid (and potentially illegal) occupancy <br />requirements, economically infeasible space limitations, or administratively <br />cumbersome (licensing) or questionable (variance) processes <br />recommendation: the regulations should reflect the overall needs of <br />the corrrnunity; if your comprehensive plan and recent surveys <br />indicate a real need for alternative forms of housing such as <br />accessory apartments, the regulation should accorrnvdate that need; <br />if, on the other hand, there really is no documented need and the <br />purpose of the ordinance is simply to force existing conversions into <br />the open and then out of existence, don't bother to put together <br />new regulations, because 1) people won't legalize if they know they <br />will be forced out, and 2) you will still have ineffective monitoring <br />and enforcement that led to the interest in this regulation; instead, <br />as above, tighten and /or simply enforce your existing regulations <br />regulate: again, such an ordinance should reflect a documented need in your <br />conrnunity for alternative housing; the purpose of such would be to allow <br />for conversions of single family dwelling units to include a subordinate <br />accessory apartment, but only when constructed and maintained in <br />accordance with certain standards <br />. reconrnendation: this is the kind of situation which requires a new <br />1 <br />.,.v... 3:1 <br />
