Mr. Steickel <br />replied that they would not. <br />Mr. DeLonais asked if the setbacks on Middle Street were being met. <br />Mr. Licht replied that they were not. <br />Mr. DeLonais stated that he would like to see the fence remain. <br />Mrs. Kingsbury pointed out that the buildings themselves would <br />become the barrier. Mrs. Timmons did not feel that the fence was <br />attractive, and that the new proposal was better. <br />Mr. Steickel stated that they have not experienced security problems <br />in the past. <br />Mrs. Timmons asked if there were any problems with the sign ordinance. <br />Steickel stated that there were not, and they would comply with the <br />ordinance. <br />Mr. Licht agreed that the improvement being suggested was a <br />positive one. However, under the variance question, the concern <br />arises if the property is adequately sized for the business. <br />Mr. Licht stated that in order to grant a variance, there must be <br />a hardship shown and the fact that the property is not large enough <br />is not a hardship. <br />Mr. Licht suggested that if the Commission wants to approve the <br />proposal that an amendment be made to the ordinance reducing the <br />side yard setback. Licht stated that under State Statute, no <br />variance is warranted. <br />Mrs. Timmons stated that Budget Power is a very reputable business, <br />and felt that there was a way to work out the problem. <br />Licht stated that the solution was an ordinance amendment. <br />Mrs. Nardini pointed out that 22 1/2 feet is a Large variance. <br />Mr. Licht pointed out that the City has forced others to comply <br />with the ordinance, but there is no justification that this <br />proposal is hotter than any others considered before. <br />Mr. Vitale asked the side yard setback in other communities. The <br />Planner replied that it is 30 to 40 feet. <br />Page -7- <br />
