MINUTES <br />Planning Commission <br />April 12, 1984 <br />1 In 10 is no duplex in a block, someone can come in and request a <br />conditional use permit and the city has no reason to deny the <br />permit. <br />The Planner reported that most cities allow for the mixing of <br />duplexes and singles, but not in R -1. Also the lot size for a <br />duplex is larger.. The Planner pointed out that under the City <br />ordinance a duplex can he put on a 10,000 square foot lot, and <br />the density on the lot is doubled. <br />'s <br />The Planner recommended that the 1 in 10 provision be eliminated <br />The Planner pointed out that most people are very surprised that <br />this provision exists. <br />Mr. Costa commented that this states that people in an R -2 area <br />are different. Mrs. Timmons pointed out that when people buy R -2 <br />property, they know what they are buying. <br />The Planner stated that people could request R -2 zoning for a duplex. <br />Timmons pointed out that with a rezoning a public hearing would be <br />held and the neighbors could be heard. <br />Mr. Costa stated that he sees duplexes now on 10,000 square foot <br />lots and no one is complaining. <br />Mr. Licht asked how the City would determine who got the duplex. <br />11r. Costa felt that the provision has worked in Little Canada. <br />Licht stated that there have been complaints at the Council level. <br />Licht stated that the original intent of the provision was to <br />provide for the mother —in —law apartment. Mr. Costa disagreed. <br />Mr. French asked where the 10 starts. Timmons pointed out that <br />the provision does not work. <br />Mr. Herkenhoff stated that he has heard complaints about this <br />happening. Herkenhoff agreed that people do not know about the <br />provision and are shocked about it when they find out. <br />Mr. DeLonais asked if there was a difference in setback requirements <br />on a duplex. The Planner stated that there was not'. <br />Mrs. Nardini pointed out that the City can create some R -2 in <br />undeveloped areas in the City. <br />Mrs. Timmons felt that the City owned it to the taxpayers living in <br />single family residential to look at the provision. <br />Mrs. Nardini stated that she lives in an R -1. neighborhood and <br />want a double next to her. <br />Page —12— <br />does not <br />
