Little Canada Planning Commission <br />9 April 1984 Page Two <br />With regard to the setbacks, the following distances are proposed: <br />Front <br />Proposed 27.3 <br />Required 40.0 <br />Rear Side With Street Frontage <br />13.8 17.5 <br />20.0 40.0 <br />The front setback is existing and considered to be grandfathered in. The <br />rear yard is a result of site constraints and is viewed positively since it <br />abuts other commercial property. The side yard abutting Middle Street <br />should be respected, however. One solution may be to move the storage <br />structure adjacent to the main building. The parking can be moved nearer <br />the property line along with the fence with almost no loss of sales area. <br />This could potentially even allow for a few more parking spaces on -site. <br />One last issue which is raised concerns zoning. Building material sales, <br />such as lumber, is not a permitted use in the B -3 zone. However, the <br />retail services in the principal structure are permitted, such as hardware. <br />Outdoor sales is a conditional accessory use in this district. In this case, <br />the building materials are viewed as accessory to the principal use, and <br />as such grandfathered in as a conditional accessory use. <br />RECOMMENDATION <br />The application for a conditional use permit for off -site parking and variance <br />for rear yard setback are recommended for approval. However, we believe <br />that the side yard setback should be maintained. It is further recommended <br />that the applicant redesign the proposal to meet this setback of 40 feet. <br />In addition, the applicant should be required to submit a signing plan for <br />review of conformance with the Sign Ordinance.
