I just found it now. I apologize for this <br />delay. I realize that you wanted the information on liability <br />for evacuation plans by the January council meeting but I hope <br />that it will still be helpful. <br />I have enclosed the following information: <br />Proposed Rules for Mobile Home Park Storm Shelter Design <br />Sample Evacuation Plans from Faribault, Spring Grove, and <br />Mounds View <br />Letter from Inver Grove Heights indicating that shelters <br />were built in the Emerald Hills Trailer Park <br />Minnesota Attorney General's Opinion, November 1, 1988 <br />Your main concern is the potential liability for the city <br />if it accepts the mobile home park's evacuation plan and does <br />not require it to build a shelter. As you can see from the <br />enclosed plans, many other cities are accepting plans where <br />residents would go to shelters outside the park. As you note, <br />the statute states that the safe place for shelter shall be a <br />"reasonable distance of the park." There is no definition of <br />"reasonable distance." The attorney general's opinion <br />discusses what a city's power is and specifically states in a <br />footnote on page 3 that "The city may require the park to <br />construct a shelter if it determines that a safe shelter is not <br />available within a reasonable distance from the park." <br />Page 19 <br />
