MINUTES <br />Planning Commission <br />March 9, 1989 <br />FinaServe <br />Sign Height <br />Variance <br />Appeal <br />(cont.) <br />Mr. Bendel stated that he agreed with Mr. Pedersen. <br />Mr. Bendel indicated that the Commission should look at the <br />long -term purpose of the Ordinance and support it. <br />Mr. DeLonais asked Mr. Wilcox if FinaServe's sign were to <br />drop to 16', would it do FinaServe any good. Mr. Wilcox <br />replied that he felt it would not. Mr. Costa felt that it <br />was ridiculous not to give FinaServe their sign; he <br />indicated that a filling station needs a sign that can be <br />seen by people driving on the freeway. Mr. Costa indicated <br />that he was in favor of helping the businessmen in Little <br />Canada, and that having FinaServe reduce their sign would <br />affect their business. <br />Mr. Wilcox indicated that FinaServe did not enter into the <br />project knowing that they could not change their sign. <br />Mr. Wilcox indicated that they thought their request would be <br />approved based on the past approvals of the Union 76 and <br />ConnCo Shoes signs. Mr. Wilcox stated that as far as <br />setting a precedent, the Council could maybe draw the line <br />with non -gas station non - freeway fronting businesses. <br />Mr. Grittman stated that approval of the ConnCo sign <br />variance was based on the topography of their land impairing <br />the visibility to their sign. Mr. Grittman reported that a <br />part of the Ordinance indicates that if a business is <br />changing ownership, the sign must be changed to conform, <br />Mr. Grittman indicated that in the case of Union 76, the <br />franchise was changing but the owner was not; therefore, <br />since Union 76 was not changing the structure of the sign, <br />they did not need a variance to change the sign facing. <br />Mr. Bendel asked Mr. Wilcox if he felt that due to <br />topography of FinaServe's property, a 16' sign would not be <br />visible. Mr. Wilcox indicated that the sign would not be <br />visible. <br />Mr. Costa recommended that FinaServe's sign variance appeal <br />for construction of a 30' sign be approved based upon their <br />remodeling. <br />Motion seconded by Mr. Herkenhoff. <br />Motion carried 4 - 2. <br />Page 6 <br />
