northwest associ2ted consultants; rn .. <br />PLANNING REPORT <br />TO: Little Canada Planning Commission <br />FROM: Michael Ridley /Stephen Grittman <br />DATE: 3 March 1989 <br />RE: Little Canada - Anderson CUP <br />FILE NO: 758.09 - 89.09 <br />BACKGROUND <br />In September. 1987, Mr. Paul Anderson, owner of the 3020 Rice <br />Street Mobile Home Park, submitted a variance request to <br />construct a garage within a rear yard setback of the park. The <br />mobile home park is a legally existing non - conforming use in a B- <br />3 zoning district. Mr. Anderson's request was denied by the City <br />Council on October 28, 1987. The Planning Commission had <br />recommended denial of the request at its October 8, 1987 meeting. <br />Concerns stated by Commission members included reasonable density <br />had already been exceeded at the site and that a negative <br />precedent may be established with City approval. Two Council <br />members suggested expansion of the existing garage as a means to <br />alleviate Mr. Anderson's storage problems. <br />Attached for reference: Exhibit A, Site Location; Exhibit B, <br />Proposed Site Plan; and Exhibit C, Previous Request Site Plan. <br />ANALYSIS <br />Non - Conforming Land Use: <br />Mr. Anderson's mobile home park property is zoned B -3 and <br />therefore the use in non- conforming. The Little Canada Zoning <br />Ordinance addresses non - conforming buildings, structures and <br />uses. One particular entry could be interpreted to apply to the <br />applicant's request.
