903.010.J. <br />Alterations may be made to a building containing lawful non- <br />conforming residential units when they will improve the <br />livability thereof, provided they will not increase the <br />number of dwelling units or the non - conformity. <br />Site Condition: <br />At the October 8, 1987 Planning Commission, it was pointed out <br />that the trailer court's internal road was not paved. At this <br />time, Mr. Anderson reported that he intended to pave the road in <br />the spring and in fact has done so. <br />Mr. Anderson has also replaced and buried electrical and <br />telephone lines, installed cable TV and installed high pressure <br />sodium street lights to previously unlit areas and elsewhere in <br />the park. All of these improvements were done at the applicant's <br />expense. <br />Storm Shelter: <br />Mr. Anderson's office basement was inspected to determine <br />acceptance as a storm shelter under Minnesota State Statutes <br />requiring all mobile home parks to provide emergency shelter for <br />park residents. The City Building Official determined that the <br />basement met all shelter criteria except for "second exit" and <br />"handicapped accessibility" requirements. <br />The applicant would like to p:covide a completely adequate storm <br />shelter facility and is proposing to do so by combining this use <br />in the expanded utility and storage building. <br />RECOMMENDATION <br />At the October 28, 1987 City Council meeting where Mr. Anderson's <br />variance request was denied, two Council members posed questions <br />regarding the possible expansion of the existing garage. The <br />applicant's current request is expansion of this garage. <br />As noted previously, Mr. Anderson has performed a number of <br />improvements on his property at his own expense in an effort to <br />enhance the appearance of his mobile home park. <br />The proposed storage /shelter expansion will require a conditional <br />use permit because the mobile home park is a non - conforming use. <br />The City must decide if the proposal meets any established <br />standards in Section 903.010 of the Little Canada Zoning <br />Ordinance regarding non - conforming uses. <br />Our office believes this request requires a policy decision on <br />behalf of the City and therefore we will not make a <br />Page 21 <br />
