AGREEMENT <br />THIS AGREEMENT, entered into this _ day of <br />1989, by and between the City of:Little Canada, a political <br />subdivision of the State of Minnesota, hereinafter called "City ", <br />and Independent School District No. 623, a public school <br />corporation under the laws of Minnesota, hereinafter called <br />"District ". <br />Section 1. Recitals. The District has approved the <br />expansion of the facilities at the Little Canada Elementary School <br />(hereinafter "School "), which expansion would include a gymnasium, <br />a stage, and related facilities, for use by its students for <br />curricular and extra - curricular activities, and the City is <br />considering providing funds for the construction of shower <br />facilities and a locker room as part of such expansion and the <br />construction of storage space, west of the stage, for use by the <br />City for storage of gymnastic and other recreational equipment, <br />which facilities would be used by all residents and others in the <br />community for recreational and civic purposes pursuant to this <br />Agreement. The gymnasium area, locker room and showers, and <br />storage space are hereinafter referred to as the "Gymnasium <br />Addition ". <br />This Agreement is entered into pursuant to Minnesota <br />Statutes, Sections 471.15 through 471.191, and Section 471.59, <br />which authorize the City and the District jointly to establish a <br />program of public recreation, and as a part thereof to acquire, <br />equip, and maintain land, buildings, and other recreational <br />facilities, to finance its acquisition, to expend other monies for <br />these purposes, and to enter into a joint agreement establishing <br />Page 2 <br />
