northwest Essociated co <br />PLANNING REPORT <br />sultEnts, Inc. <br />TO: Little Canada Planning Commission-- - <br />FROM: Stephen Gr.ittman <br />DATE: 8 May 1989 <br />RE: Little Canada - Stellick Lot Split <br />FILE N0: 758.09 - 89.24 <br />BACKGROUND <br />Mr. James Stel. lick has applied for a subdivision of a parcel from <br />the Market Place Shopping Center property. The purpose of this <br />split is apparently to separately mortgage a center expansion. <br />The parcel is located at the east end of the existing building, <br />adjacent to the Garden Terrace Apartments. <br />ANALYSIS <br />The division of this parcel is not unusual in the context of a <br />multi- tenant development. We do have some concern procedurally, <br />however. First, a number of easements cross the property, some <br />extending under the existing building. By creating a new parcel <br />here, the City is in effect making some representation as to the <br />'ability of the site to be built upon. These easement questions <br />should be addressed at the time of submission. Second, the lot <br />would have no public street access. An easement for access <br />extends from Market Drive only as far as the Garden Terrace <br />parcel. Creating a lot with no street frontage is counter to <br />Ordinance requirements. <br />Third, the resulting property descriptions are extremely long. <br />Their length makes verification of the description a particularly <br />difficult and confusing task. There may be some question as to <br />whether the County will accept the descriptions for recording. <br />Fourth, the center was originally processed as a Conditional Use <br />Permit PUD. Any expansion would have to be processed as an <br />amendment to that PUD.
