Moser Second <br />Accessory Building CUP Request <br />758.09 - 89.27 <br />Mr. Robert G. Moser has filled out an application for a <br />conditional use permit to allow alterations to his property zoned <br />R -1, Single Family District located at 3097 LaBore Road. Mr. <br />Moser is proposing to add on a three season porch and attached <br />garage to his home and to replace two storage buildings measuring <br />14' x 22' and 8' x 16' by moving the existing stucco garage. <br />Moving the existing stucco garage will require a conditional use <br />permit. Please refer to attached Exhibits. <br />ISSUES AND ANALYSIS <br />A conditional use permit is required for a second accessory <br />building pursuant to Section 903.020.D.5., where it states that <br />no building permit shall be issued for the construction of more <br />than one (1) detached or attached private garage for each single <br />family dwelling, except by conditional use permit. This proposed <br />building is actually the first detached garage, therefore, making <br />it a second garage or accessory building which requires a CUP. <br />It should be noted that the CUP request is for a private garage <br />and not for commercial use. Commercial uses are not permitted in <br />R -1 zones. Additionally, the storage of cars outside the garage <br />is highly discouraged and would be a condition of CUP approval. <br />The applicant is intending to utilize the proposed garage as a <br />place for storing lawn mowers, snowmobile trailers, etc. <br />Page 24 <br />4601 excelsior blvd., ste. 410, minneapolis, mn 55416 (612) 925 -9420 fax 925 -2721 <br />
