Mr. Fleischhacker agrees to construct an approved City <br />street to the proposed landlocked parcel to be included as <br />part of the development contract. <br />5. Comments of other City staff. <br />ISSUES ANALYSIS <br />In May of 1988, Mr. Fleischhacker had applied for and was <br />approved for a variance to reconstruct a loading dock (for the <br />3202 Rice Street property) removed because of the expansion of <br />Rice Street. This variance request was granted based on the <br />condition that the property would be cleaned up. <br />According to an inspection conducted in May of 1988 by the City <br />Building Official, the property had become a refuge area for <br />parked vehicles, trailers and various other debris. Our office <br />conducted an inspection to determine current site conditions. <br />The site inspection was conducted on 7 June 1989 (please refer to <br />attached site photos). The property continues to be a refuge for <br />debris and parked vehicles. <br />The 25 May 1988 City Council meeting minutes regarding this <br />matter state that Mr. Fleischhacker had agreed to clean up his <br />property within 60 days in lieu of posting a bond at the time the <br />building permit was issued. The bond was not required and clean <br />up was never accomplished. <br />In addition to the clean up issue, a Council member questioned if <br />the property was being filled due to the increased size of the <br />property noted in aerial photos taken in 1981 and 1983. Mr. <br />Fleischhacker stated that the fill was excess dirt from the <br />street widening. Fill still remains on the property and should <br />be addressed along with the clean up issue prior to subdivision <br />approval. <br />Zoning. The property is currently zoned B -3, General Business <br />District. The two parcels created after the lot split would <br />remain B -3. All uses on the site conform to the Ordinance with <br />the exception of the outdoor storage use. Outdoor storage is <br />permitted as a conditional use provided the area is fenced and <br />screened from view and the storage area is grassed or surfaced. <br />Page 59 <br />
