Provision 16 under Section 912.040 states that all conditions <br />pertaining to a specific site are subject to change when the <br />Council, upon investigation in relation to a formal request, <br />finds that the general welfare and public betterment can be <br />served as well or better by modifying the conditions of the <br />conditional use. Our office would recommend an evaluation of <br />the conditional use of outdoor door storage on the site. <br />Subdivision. The proposal is a simple subdivision in which case <br />the Council may, when deemed appropriate, waive the requirement <br />for a plat and public hearing. The Commission /Council may impose <br />conditions and restrictions which are deemed necessary during <br />subdivision review. Our office would recommend the resolution of <br />the outdoor storage and fill issues prior to the acceptance of <br />the subdivision or condition the acceptance of the subdivision on <br />a clean up schedule to be included within a development contract <br />to insure compliance (with bond posting required). <br />In addition to the clean up issue, the City will have to respond <br />to the proposed alley vacations. Alley "F" and alley "I" are <br />proposed for vacation. The alley vacations and the lot split <br />will result in the "landlocking" of the remaining west portion of <br />the lot. All of Block 11 is located between two unopened <br />streets. Mr. Fleischhacker will be required to improve Third <br />Street to provide proper access to the western part of the Block <br />to be subdivided. A final item will be utility provision to the <br />site to be resolved by the City Engineer. <br />CONCLUSION <br />Due to the site inspection and other related issues, our office <br />recommends approval of the simple subdivision to be subject to <br />the recommendations and contingencies outlined in the Executive <br />Summary.
