The applicant has agreed to these conditions in advance. He has <br />requested that staff allow the moving of the structure to the <br />site prior to the City Council's final approval as the Hardee's <br />site must be cleared before the Council can hear the proposal. <br />Staff has agreed to this request on a temporary basis only if the <br />Planning Commission recommends approval. <br />RECOMMENDATION <br />We recommend the approval of the conditional use permit to allow <br />the moving of a garage onto the subject site contingent upon the <br />following: <br />o Structure meets approval of the Building Official. <br />o A security is posted for the operation according to City <br />Code. <br />o The structure is placed according to the site plan in <br />conformance with Zoning Ordinance requirements. <br />o The applicant agrees to remove the structure within seven <br />days if the CUP is not formally approved by the City <br />Council. <br />cc: Kathy Glanzer <br />John Palacio <br />Tom Sweeney <br />Don Carley <br />Jeff DeBace <br />Page 13 <br />
