Minnesota 55155 <br />Dear Representative Valento: <br />SUBJECT: 35E and Little Canada Road <br />C. S. 6280 (35E) <br />779 -1178 <br />Telephone <br />Thank you for your letter of July 11. 1989. regarding the project at 35E and Little <br />Canada Road. <br />Project personnel have contacted Lunde Construction in regards to the damage <br />to a property owner's tire. The contractor has agreed to settle this claim with <br />the property owner. There was some question in regards to the value of the <br />tire and the validity of the claim. Therefore. settlement will be on a negotiated <br />basis. <br />Prior to construction in this area, the Minnesota Department of Transportation <br />(Mn /DOT) did investigate and found no property corners. The land owner <br />apparently owns lands on the north and south sides of Little Canada Road. Pins <br />were found on the vacant lot on the north side. These can be re- established <br />if they are missing. The south side would involve a complete land survey to <br />re- establish. Because the corners were not in place. Mn /DOT should not be <br />responsible to do so. <br />The City of Little Canada was responsible to purchase a right of way easement <br />for the construction of this project. The agreement with the City indicates <br />that the area would be restored to the condition in which it existed as of the <br />date of the purchase agreement. <br />Sincerely, <br />Kermit K.
