PLANNING REPORT <br />northwest associated consultants, inc. <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: 3 April 1986 <br />RE: Dukowitz Variance Request <br />FILE NO: 758.09 - 86.07 <br />BACKGROUND <br />Mr. William Dukowitz has applied for a side yard setback variance to allow con- <br />struction of a single family residence on his lot along Burke Lane (see Exhibit A). <br />The variance is requested on the east side yard which borders the unimproved <br />30 foot Condit Lane right -of -way. The City Council denied a vacation of Condit <br />in this area in October of 1985. The reason given was that the presence of un- <br />developed property in the area made it unwise to vacate in the event that right - <br />of -way is required in the future. <br />ANALYSIS <br />Exhibit B shows the plat of the Burke Lane area, with the lot in question high- <br />lighted. Exhibit C illustrates the lot with the proposed location of the new <br />residence. The west side yard is shown at 10 feet, the ordinance minimum. The <br />west setback is shown at 14 feet, short of the required 30 feet for a side yard <br />fronting on a public street. <br />The Ordinance specifies that variances are to be evaluated under the following <br />criteria: <br />a. Special conditions and circumstances exist which are peculiar to the land, <br />structure, or building involved. <br />1(1) Special conditions may include exceptional topographic or water <br />conditions or, in the case of an existing lot or parcel of record, <br />narrowness, shallowness, insufficient area or shape of the property. <br />4820 minnetonka blvd., ste. 200, minneapolis, mn 55416 (612) 925 -9420 <br />Page 36 <br />
