MINUTES <br />PLANNING COMMISSION <br />October 12, 1989 <br />minimum of 10,000 square feet for residential lots. <br />McTeague reported that the City granted the property a <br />variance for lot width when he first bought the <br />property 12 years ago. McTeague reported that at the <br />time Sylvan Street was improved, the City deferred the <br />assessments for the street until such time as the lot <br />might be divided. McTeague pointed out that the lot <br />could not be divided without a variance. <br />Drabik pointed out that by constructing a garage on <br />Sylvan Street, McTeague would be using the street just <br />like other property owners along it. Drabik felt it <br />would not be fair not to assess the property for Sylvan <br />Street in the event that the street is being used. <br />Mrs. McTeague pointed out that other property owners <br />along Sylvan Street are also using sewer and water, <br />while they would not be. <br />Drabik asked if the assessments could be broken down, <br />and the McTeague property only assessed for the street <br />portion of the improvement. <br />The Planner replied that that is a possibility. <br />Costa asked if the garage could be accessed from Stark <br />Street. <br />McTeague replied that it could not since the yard is <br />terraced and there is quite an elevation change. <br />The City Planner stated that he is concerned about a <br />precedent being set in allowing Sylvan Street to be <br />used but not assessing for the cost of the street. <br />McTeague pointed out that his son would be the only one <br />using the street, and felt that the rational being used <br />would justify a two -car family being assessed double <br />for street access. <br />The Planner reported that through lots are now allowed <br />on new plats just because of the problems being <br />discussed tonight. <br />Mrs. McTeague pointed out that the property still has <br />access to Sylvan Street even if a garage is not <br />constructed. <br />Page 5 <br />
