MINUTES <br />PLANNING COMMISSION <br />October 12, 1989 <br />Mr. McTeague pointed out that he pays higher property <br />taxes just because of the amount of land he has. <br />Mr. Schorn, property owner in the area, pointed out <br />that the Zoning Code only allows one driveway per lot. <br />McTeague asked if he could construct a car port on the <br />property without need for a Conditional Use Permit. <br />The Planner replied that he could, however, the issue <br />of the second driveway would still exist. The Planner <br />stated that he has nothing against the garage being <br />proposed, the issue is the City's assessment policy. <br />The Planner stated that the garage would probably fill <br />a hole on the facade of the street, but how could the <br />City rationalize abating the assessments for the street <br />on this lot and then allowing access to the street. <br />The Planner pointed out that the garage could be <br />constructed, and sometime in the future Mr. and Mrs. <br />McTeague could sell the property and a home could be <br />constructed on Sylvan. <br />McTeague reported that his assessments were not waived, <br />but deferred until such time as the lot is split. <br />There is interest accruing on the assessment. <br />The Planner stated that the City Council will have to <br />review its assessment policy. If a Conditional Use <br />Permit is granted, the property owner is allowed access <br />to the street. The Planner stated that he has <br />discussed the issue with the City Attorney, who <br />indicated that the City has the authority to levy the <br />assessment against the property. <br />DeLonais pointed out that it is the Council's job to <br />review its assessment policy. <br />Drabik agreed, pointing out that the issue for the <br />Commission is the garage itself. <br />The Planner stated that if the Commission felt the <br />garage appropriate in the location proposed, it could <br />recommend approval subject to Council review of the <br />assessment issue. <br />Mr. Herkenhoff recommended approval of the Conditional <br />Use Permit requested by Mr. Terry McTeague, 2565 Stark <br />Street, to construct an accessory garage on Sylvan <br />Street subject to the recommendations of the City <br />Page 6 <br />
