MINUTES <br />PLANNING COMMISSION <br />October 12, 1989 <br />Arcilla again stated that he wanted to improve on what <br />he currently has and stated that the plan proposed is <br />the one that he prefers. Arcilla stated that he spent <br />a lot of time working on this plan. <br />Pedersen asked if the property was purchased subject to <br />a building permit being issued. <br />Arcilla replied that this was not the case, that he <br />owned the lot. <br />Mr. George Warren, Lakeside Court, stated that he <br />opposed the variance. Mrs. Lepsche stated that she was <br />opposed to the variance since she felt a precedent <br />would be set. <br />Arcilla again stated that it is the shape of the lot <br />that is the problem and the house plan selected is the <br />one he prefers. <br />Drabik stated that the type of house plan Mr. Arcilla <br />prefers is not the Commission's concern. The problem <br />is that the neighbors are opposed to the variance, and <br />it is possible to construct a home on the lot that <br />would conform to setbacks. <br />Arcilla stated that he believes his request meets the <br />conditions as outlined in the City Planner's letter. <br />DeLonais pointed out that the Commission is a <br />recommending body, and final decision will be made by <br />the City Council. DeLonais pointed out that the <br />neighbors have complied with setback requirements. <br />DeLonais felt that Arcilla should have investigated the <br />situation prior to purchasing the lot. <br />Costa felt that Mr. Arcilla could have an architect <br />modify the house plan so that it would fit on the lot. <br />Ms. Drabik recommended that the variance request of Mr. <br />Ely Arcilla to construct a home at 641 Keller Parkway <br />with a 10 foot rear yard setback be denied due to the <br />objections of the neighbors and since the property <br />appears to be large enough for a home to be constructed <br />on it that will conform to setback requirements. <br />Motion seconded by Mr. Herkenhoff. <br />Motion carried 4 - 1.
