CONCLUSION <br />Unless the City deems the Wescot request an appropriate method of <br />outdoor display and advertising for the intended use of the site, <br />our office would not recommend approval of the application due to <br />the potentially precedent setting situation that would occur. <br />Conditions to be considered if the City determines the <br />application appropriate should include: <br />1. The modular structure must comply with maintenance and <br />electrical sections of the Minnesota State Building Code. <br />2. The structure may not be erected within or protrude over <br />public /private right -of -way, access route, public land, or <br />easement or parking area. <br />3. The City will need to determine appropriate size and areas <br />based on those stated in Section 903.110 signs or be <br />determined as part of the conditional use permit process. <br />4.
