CONCLUSION
Unless the City deems the Wescot request an appropriate method of
outdoor display and advertising for the intended use of the site,
our office would not recommend approval of the application due to
the potentially precedent setting situation that would occur.
Conditions to be considered if the City determines the
application appropriate should include:
1. The modular structure must comply with maintenance and
electrical sections of the Minnesota State Building Code.
2. The structure may not be erected within or protrude over
public /private right -of -way, access route, public land, or
easement or parking area.
3. The City will need to determine appropriate size and areas
based on those stated in Section 903.110 signs or be
determined as part of the conditional use permit process.
4. All illumination must be hooded in conformance with the
Ordinance and the structure may not be illuminated between
Midnight and 6:00 AM.
5 A survey must be submitted illustrating proper placement and
setbacks for City review.
cc: John Palacio
Don Carley
Tom Sweeney
Kathy Glanzer
Scot Wesch
Page 43
■
■
