The modular structure can comply with the above mentioned <br />provisions, however, must also conform to Section 921.010, C <br />concerning adverse effects to the proposed conditional use. The <br />Planning Commission will need to determine the following: <br />1. The proposed action has been considered in relation to the <br />specific policies and provisions of and has been found to be <br />consistent with the official City Comprehensive Land Use <br />Plan. <br />2. The proposed site is or will be compatible with present and <br />future land uses of the area. <br />3. The proposed use conforms with all performance standards <br />contained in the Ordinance. <br />4. The proposed use will not tend to or actually depreciate the <br />area in which it is proposed. <br />5. The proposed use can be accommodated with existing public <br />services and will not overburden the City's service <br />capacity. <br />The Planning Commission will need to determine the <br />appropriateness of a display advertising device of this nature as <br />it relates to present and future land uses within that area and <br />if it is consistent with the policies of the Comprehensive Plan. <br />Planning District 23, where the site is located, has been <br />identified in the Little Canada Comprehensive Plan as a district ' <br />that will primarily be office /industrial in nature. An <br />advertising /display mechanism of this type would be more <br />indicative of a retail/ commercial area although our office would <br />like to point out that the appropriateness may be questioned in a <br />retail area as well. The Comprehensive Plan does mention the <br />warehouse mini - storage facility and indicates that further <br />development in the district should be similar in nature. The <br />Planning Commission must determine if the intent of Planning <br />District 23 allows for this type of retail advertising as now <br />being requested. <br />As outlined earlier in this report, it can be determined that the <br />proposed use does not conform with all performance standards <br />contained within' the Ordinance. The Ordinance simply does not <br />address this type of request. Approval of this type of outdoor <br />display /advertising could become a precedent setting action <br />because of the Ordinance's lack of regulating mechanisms. Any <br />future requests of this kind could site the Wescot CUP as an <br />example to follow to obtain permits for similar kinds of outdoor <br />advertising. <br />Page 42 <br />
