Although the policy section of the 1979 Plan allows for an <br />interpretation that properties such as the one in question should <br />be of a limited business use, the Proposed Land Use Plan and <br />Proposed Zoning Change section did not recommend any change from <br />single family. The City has taken some steps in the direction of <br />Rice Street land use in recent months. Much of the Rice Street <br />area was rezoned to commercial in 1989. The City should decide <br />what the future land use of this parcel is to be. The State <br />Enabling Legislation requires Comprehensive Plans and zoning to <br />be consistent, that is, zoning may not be allowed to interfere <br />with the long term establishment of the land use specified by the <br />Comprehensive Plan. <br />It should be noted that the parcel to the north on Rice Street is <br />in the same situation, although the land to the north of it is <br />zoned residential. The eventual, long range land use of this <br />area should be determined and properly addressed in the City's <br />land use controls. The options are essentially single family (as <br />zoned) or commercial (as used). If the commercial route is <br />preferred, a B -1 zoning may be more appropriate as it restricts <br />retail use which can be the most disruptive to surrounding <br />residential areas. Such a decision would allow the resolution of <br />the refinancing issue, as well as give some assurance to the <br />neighborhood as to land use of the parcel. The policy plan <br />section of the Comprehensive Plan would encourage this direction, <br />although an amendment to the land use map would be recommended. <br />SUMMARY <br />The City must address the preferred land use of the subject <br />parcel (as well as that of the parcel to the north). If <br />commercial use is appropriate, the Comprehensive Plan should be <br />amended to show the property as commercial use, and rezoning <br />should be approved for a Business District. As noted above, we <br />would recommend a B -1, Limited Business District which is more in <br />keeping with Comprehensive Plan policy and restricts active <br />retail use of the site. If the city prefer residential as the <br />long range land use, the Comprehensive Plan and Zoning Map may be <br />left as they are.
