4.1.2. "Construction cost of the Project" as herein referred to <br />means the total cost of all work designed or specified by the <br />Consultant for the Project, including Change Orders resulting from <br />the City's request to change the scope of the Project but not <br />including those caused by the Consultant's errors or oversights in <br />design and less any costs associated with any quantity overruns not <br />resulting from a City requested change in project scope, but does not <br />include any payments to the Consultant or other consultants, <br />surveyors, lawyers, appraisers, testing companies, etc., the cost of <br />the land, right -of -way or easements, nor other costs which are the <br />responsibility of the City as provided herein in SECTION 3. <br />4.1.3. Progress payments to the Consultant shall be made in <br />proportion to services performed. The compensation for Basic <br />Services shall be paid according to the following percentage of the <br />fee specified in Section 4.1.1 at completion at each phase of the <br />work: <br />a. Upon completion of the Preliminary Report Phase the City <br />will pay to the Consultant a sum equal to 20% of the <br />Consultant's fee or a sum based upon the actual time spent <br />at the rates shown on Schedule "B" attached. <br />b. Upon completion of the Final Design Phase the City will pay <br />to the Consultant a sum equal to 85% of the Consultant's <br />fee, based upon the total amount of the contract for the <br />Project let by the City, less any sum previously paid. <br />c. For services rendered in the Construction Phase the City <br />will pay to the Consultant a sum equal to 100% of the <br />Consultant's fee, based upon the actual total construction <br />cost of the Project, Less any sum previously paid, payments <br />will be made monthly in direct proportion to the <br />construction work completed. <br />Page 13 <br />Page 28 <br />
