4.1.2. "Construction cost of the Project" as herein referred to means the total cost of all work designed or specified by the Consultant for the Project, including Change Orders resulting from the City's request to change the scope of the Project but not including those caused by the Consultant's errors or oversights in design and less any costs associated with any quantity overruns not resulting from a City requested change in project scope, but does not include any payments to the Consultant or other consultants, surveyors, lawyers, appraisers, testing companies, etc., the cost of the land, right -of -way or easements, nor other costs which are the responsibility of the City as provided herein in SECTION 3. 4.1.3. Progress payments to the Consultant shall be made in proportion to services performed. The compensation for Basic Services shall be paid according to the following percentage of the fee specified in Section 4.1.1 at completion at each phase of the work: a. Upon completion of the Preliminary Report Phase the City will pay to the Consultant a sum equal to 20% of the Consultant's fee or a sum based upon the actual time spent at the rates shown on Schedule "B" attached. b. Upon completion of the Final Design Phase the City will pay to the Consultant a sum equal to 85% of the Consultant's fee, based upon the total amount of the contract for the Project let by the City, less any sum previously paid. c. For services rendered in the Construction Phase the City will pay to the Consultant a sum equal to 100% of the Consultant's fee, based upon the actual total construction cost of the Project, Less any sum previously paid, payments will be made monthly in direct proportion to the construction work completed.
