Ordinance Requirements. As shown on the submitted site plan, the <br />applicant wishes to construct a pylon sign measuring 33 feet in <br />height and 204 feet in area. According to Section 903.110.E.5.c. <br />of the City Ordinance, buildings with a floor area in excess of <br />24,000 square feet are allowed a maximum height of 25 feet and a <br />maximum area of 200 feet. <br />It should be noted that a recent Sign Ordinance amendment which <br />allowed a maximum 30 foot sign height for certain properties is <br />inapplicable. According to the amendment, on parcels which have <br />a common property line with the right -of -way of limited access <br />freeways, the maximum sign height shall be allowed to be 30 feet <br />regardless of building size. Because the subject property does <br />not share a common property line with Highway 35E, it is exempt <br />from the conditions of the amendment. <br />Hardship. In August of 1987, this same height and sign area <br />request was brought before the Council. The Council determined <br />that the applicant was under no hardship and subsequently denied <br />both requests stating that the granting of the variance would <br />give the applicant an unusual privilege not enjoyed by other <br />properties in the same district. As such, the sign's height and <br />area should be reduced to conform to the stated Ordinance <br />requirements. <br />Wall Mounted Sign. In addition to the pylon sign, a wall mounted <br />"Clearance Center" sign is to be. located upon the structure's <br />western facade, directly above the proposed retail area's <br />principal entry. At 29 square feet in area, the sign lies well <br />within maximum sign area requirements and is considered <br />acceptable. <br />RECOMMENDATION <br />Review of the applicant's request to provide retail sales within <br />the existing Slumberland facility has been found to be generally <br />acceptable. In regard to the sign variance request, it is the <br />view of our office that sufficient hardship has not been <br />demonstrated which would warrant its erection as dimensioned. <br />As such, our office recommends approval of a CUP to allow <br />accessory retail sales within an I -2 Zoning District and the <br />erection of a Slumberland pylon sign provided it is modified to <br />meet Ordinance requirements. All approvals, however, shall be <br />contingent upon the fulfillment of the following conditions: <br />1. The applicant demonstrate the ability to provide 207 parking <br />stalls upon the subject site as required by Ordinance. <br />5 <br />Page 41 <br />
