Percentage of Retail Use. According to Section 918.040 of the <br />City Ordinance, accessory retail uses such as proposed may not <br />constitute more than ten (10) percent of the gross floor area of <br />the principal structure. The 5,248 square feet, which is to be <br />devoted to retail activities, constitutes only three percent of <br />the principal structure's gross building area of 161,140 square <br />feet. As such, the amount of retail space to be provided lies,in <br />conformance with Ordinance standards and is considered <br />acceptable. <br />Loading. As shown on the attached building floor plan, a <br />customer pick up lane is to be provided on the structure's south <br />side, directly west of the facility's semi -truck trailer <br />receiving doors. The loading area appears well placed and shall <br />not conflict with either pedestrian or vehicular movements. <br />SIGN VARIANCE <br />As mentioned previously, the applicant has requested a variance <br />to allow a pylon sign to exceed Ordinance height and area <br />requirements. The proposed erection of the sign follows the <br />intention of the applicant(s) to provide and promote retail sales <br />within the existing office /distribution /warehouse center. <br />Evaluation Criteria. In evaluating the applicant's request, the <br />City Ordinance has set forth a number of criteria from which the <br />subject variance may be judged. Per Section 922.010 of the <br />Ordinance, a variance shall not be granted unless it can be <br />demonstrated that: <br />a. Special conditions and circumstances exist which are <br />peculiar to the land, structure, or building involved. <br />b. Literal interpretation of the provisions of the Ordinance <br />would deprive the applicant of rights commonly enjoyed by <br />other properties in the same district under the terms of the <br />Ordinance. <br />c. The special conditions and circumstances do not result from <br />the actions of the applicant. <br />d. Granting the variance will not confer on the applicant any <br />special privilege that is denied by this Ordinance to other <br />lands, structures, or buildings in the same district. <br />e. A genuine hardship exists in complying with the literal <br />terms of the Ordinance. <br />4 <br />Page 40 <br />
