The property owner shall be responsible for <br />replacement of any dead trees, shrubs, ground covers and <br />sodding. <br />The City of Eden Prairie has very complete and specific <br />landscaping contracts requiring all developers to complete <br />and sign a landscape agreement that includes one of the <br />following: a surety bond, letter of credit, or escrow fund. <br />These contracts are used to enforce the landscaping <br />requirements and to guarantee future maintenance. A copy of <br />Eden Prairie's landscaping application procedure is attached <br />for reference. <br />CONCLUSION <br />As demonstrated by the foregoing analysis, there are no uniform <br />accepted approaches to addressing a landscaping/ screening <br />standard. Important to recognize, however, are the areas in <br />which the City can add to or expand on their existing ordinance. <br />Many of the cities surveyed had similar requirements to Little <br />Canada's, however, go into more specific detail. The level of <br />detail becomes an important consideration and should the City <br />find it necessary to adopt additional landscaping requirements, <br />then it is recommended that a maintenance and replacement clause <br />be added to aid enforcement procedures. In this regard, our <br />office has attached the City of Eden Prairie's landscape <br />agreement procedures for review and consideration.
