MINUTES <br />PLANNING COMMISSION <br />JULY 11, 2013 <br />Schwalbach recommended approval of a Conditional Use Permit for <br />outdoor storage and an Interim Use Permit allowing outdoor storage for an <br />off -site tenant, requested by John Krebsbach for property located at 3177 <br />Spruce Street, subject to compliance with the recommendations of the City <br />Planner as outlined in his report dated July 5, 2013, and subject to <br />submittal of an appropriate site plan prior to the July 24th Council meeting. <br />Motion seconded by Barraclough. <br />Motion carried 5 — 0. <br />VARIANCE Mark Lillemoen, representing Roger Lillemoen at 180 Ryan Drive, <br />& CUP — appeared before the Commission requesting a Variance from the minimum <br />180 RYAN lot width standards in the I -1 District and an Amendment to Conditional <br />DRIVE — Use Permit for outdoor storage. <br />LILLEMOEN <br />The City Planner informed the Commission that he is amending the <br />recommendation in his report to support the Variance request. The <br />Planner indicated that in discussing this application with City staff, he had <br />focused on the designation of front yard for this property, and did not <br />focus on the location of outdoor storage that the applicant was requesting. <br />Then in preparing the report and reviewing Code requirements, it was <br />noted that the Code does not allow outdoor storage in any yard between <br />the building line and a public street. The Planner also reported that on <br />additional review, there are corner lots in Ryan Industrial Park which have <br />outdoor storage in similar locations as what the applicant is requesting. <br />The Planner noted that in considering a Variance the City must find that <br />the proposed use is reasonable and there are practical difficulties in <br />complying with ordinance requirements. These practical difficulties must <br />be unique to the property, not caused by the applicant, non - economic in <br />nature, consistent with the intent of zoning regulations, and not in conflict <br />with the neighborhood. The Planner indicated that given the location of <br />this property on the a curve, the lot's unique shape, and the shallowness of <br />the rear yard of the property, his position is that the standards for a <br />Variance are met. He also noted that the request is similar to the way <br />some other corner lots in Ryan Industrial Park are being used. <br />Mark Lillemoen described the site plan for the Commission showing the <br />outdoor storage area at the northeast corner of the building. He pointed <br />out that one of the building tenants has a tent -type temporary structure in <br />this storage area that he utilizes to store his truck in when the truck is <br />loaded with salt for de -icing pavement. Lillemoen asked if this structure <br />could remain on the property. Duray asked if the structure would remain <br />year - round. Lillemoen thought that it would.
