MINUTES <br />PLANNING COMMISSION <br />JULY 11, 2013 <br />Schwalbach recommended approval of the Variance from the minimum <br />lot width standards and allowing outdoor storage in the lot area between <br />the building and public street as proposed by Roger Lillemoen for <br />property located at 180 Ryan Drive subject to outdoor storage complying <br />with City Code requirements. <br />Motion seconded by Barraelough. <br />Motion carried 5 — 0. <br />Schwalbach recommended approval of the Amendment to Conditional <br />Use Permit for outdoor storage at 180 Ryan Drive subject to compliance <br />with City Code requirements. <br />Motion seconded by Fischer. <br />Motion carried 5 — 0. <br />AMENDMENT The City Planner reviewed his report dated July 8, 2013 relative to <br />TO ZONING a proposed amendment to Accessory Use standards in the R -1 Zoning <br />CODE — District related to boarding and renting of rooms. The Planner <br />SINGLE - reported that City staff has noted issues of concern that arise from the <br />FAMILY renting of single- family homes when the resident population fails to <br />ACCESSORY utilize the unit as a common household. Typical problems include <br />USES & inadequate indoor facilities and /or outdoor spaces such as recreational <br />DEFINITION space, parking space, storage space, and other factors that become <br />OF FAMILY stressed when a number of persons occupy a dwelling unit, but do not <br />function as a housekeeping unit. <br />The Planner reported that City staff had asked that the definition of family <br />be amended to address the concerns. He noted that a few years ago the <br />City updated the definition of family to address Federal Fair Housing <br />requirements in order to ensure its zoning regulations remained consistent <br />with those requirements. The Planner again noted that renting and <br />boarding of single- family homes have resulted in some instances where <br />reasonable expectations of single- family home usage have been exceeded. <br />In reviewing the applicable regulations, it appears that traditional <br />allowances for boarding and renting rooms to up to 2 people are <br />inconsistent with the expanded definition of family. The Planner reported <br />that the matter has been reviewed the City Attorney who is recommending <br />that the Accessory Use provisions be amended to address the issues of <br />concern rather than modifying the definition of family. The Planner <br />reviewed the recommended ordinance amendment which reads as follows: <br />G. Boarding or renting of rooms to not more than two (2) persons, <br />-6- <br />
