MINUTES <br />PLANNING COMMISSION <br />JULY 11, 2013 <br />and subject to the definition of "family" in Section 902.010 of this <br />Ordinance, provided that: <br />1. The property owner maintains a rental license with the <br />City; <br />2. The occupants of the dwelling unit maintain a common <br />household as a single- family dwelling; <br />3. The property maintains outside parking of no more than <br />four (4) personal or business - related motor vehicles, with <br />the exception of vehicles parked on the property by <br />temporary guests of the occupants. <br />Murphy asked what the benefit was to the City of requiring the rental <br />license. The City Planner reported that the advantage is that the City has <br />another enforcement tool to ensure that commonly- expected maintenance <br />requirements are being met. Schwalbach has if items such as grass cutting <br />was enforced in other areas of the Code. The City Planner replied that <br />they were, but the rental license would be another enforcement tool. The <br />Planner also reported that under the City's Rental Licensing Ordinance, <br />rental properties must be inspected. The City Clerk gave a brief summary <br />of the Rental Licensing Ordinance. <br />Murphy noted that the proposed amendment limits outside parking to four <br />vehicles. She asked about owner- occupied single - family homes and the <br />impact on families with numerous drivers. The City Planner indicated that <br />this provision would not apply to owner - occupied single - family homes. <br />Schwalbach noted the City Code's definition of "family" and asked about <br />a definition of "boarder ". The City Planner replied that the definition of <br />"boarder" is a statutory definition. <br />Duray reported that he was comfortable with the proposed ordinance <br />amendment given that there is no change proposed to the definition of <br />"family ". <br />Fischer asked how many single - family homeowners had boarders. The <br />City Planner stated that that number is not known. Requiring a rental <br />license will help the City in tracking that number, however. <br />Duray recommended approval of the Amendment to Accessory Use <br />Provisions in the R -1 Zoning District relative to boarding or renting of <br />rooms as proposed by the City Planner. <br />Motion seconded by Fischer. <br />Motion carried 5 — 0. <br />-7- <br />
