Mayor Fahey and Members of the City Council <br />October 19, 1990 <br />Page 2 <br />Change Order E - This change order should be <br />approved. One may question why the requirements <br />of the Health Department were not undertaken <br />during the first project. In talking with Bill <br />Sanders, he informed me that they had conferred <br />with the Health Department on this project and the <br />Health Department stated that the project as <br />proposed was acceptable and final approval was <br />essentially up to the City. When the building <br />project was proposed, John Palacio asked that <br />these plans be submitted to the Health Department <br />as part of the building review process. It was at <br />that time that the Health Department made its <br />present determinations. While one may question <br />the coordination of this issue, the money is due <br />and payable to the contractor. <br />Change Order F - It is my opinion that this change <br />order is unacceptable to the City. This issue <br />needs further discussion between the electrical <br />engineer, electrical contractor, and the supplier <br />of the fixtures. It is my opinion that the City <br />should have no financial responsibility in this <br />matter and those three parties should work out an <br />appropriate solution. <br />* Change Order G - This change order should be <br />approved. The question raised is why the <br />electrical engineer did not revise the fixture <br />schedule in conjunction with his revision to the <br />project drawings. <br />* Change Order H - It is my recommendation that we <br />not approve this change order at this time. <br />Apparently, the irrigation system was damaged by <br />an unknown party. However, it seems obvious to me <br />that the City was not responsible for the damage. <br />Therefore, this issue should be addressed between <br />the contractors on both projects to make a <br />determination as to who is responsible for this <br />cost. I do not feel that this should be a cost to <br />the City. <br />My recommendation for approval of these change orders is <br />subject to the Recreation Association making funding <br />available for the change orders not related to the <br />irrigation system. The Recreation Association does not <br />have a scheduled meeting until November. Therefore, the <br />conditionally approved change orders will be held for <br />payment until funds are provided. <br />Page 104 <br />
