While a distance <br />of 300 feet provides a degree of protection, an even larger <br />separation would be preferred. Going beyond 300 feet, however, <br />is seen as potentially jeopardizing what would possibly be viewed <br />as an acceptable location or sufficiently sized opportunity area. <br />The 300 foot_ spacing is therefore recommended as a compromise <br />which balances all factors to be considered. <br />Carrying the analysis one step further, all the adult use general <br />provision limitations of the proposed Zoning Ordinance need to be <br />addressed. Upon reviewing the location of any "protected uses" <br />in the City, none were located within the B -3 Zoning District and <br />therefore providing no further boundary restrictions for adult <br />use. <br />The City's decision makers should carefully review this <br />information in resolving the spacing factors to be included in <br />the finally enacted Zoning Ordinance amendment. <br />LICENSING <br />A final mechanism available to the City which will assist in <br />assuring adult uses are properly operated is licensing of such <br />establishments. The primary concerns in this regard are <br />restricted access to minors, the character of the business <br />operators and the prevention of criminal activities. In response <br />to these concerns, a new licensing section has been drafted, as a <br />proposed amendment to the Municipal Code as Chapter 817. The <br />content of this section is intended to focus upon assuring proper <br />adult use operation. These factors require thorough review by <br />City officials. These licensing provisions are found in Exhibit <br />C of this report and again require detailed review by City <br />officials.
