MINUTES <br />PLANNING COMMISSION <br />DECEMBER 13, 1990 <br />ALLEYWAY Mrs. Lam, 92 Bryan Avenue, appeared before the <br />VACATION Commission requesting approval of the vacation of an <br />HOC BAO LAM alleyway easement directly south of her property. It <br />was reported that the Lam's have constructed a fence in <br />their rear yard which extends onto the alleyway <br />easement. Without the vacation, the fence will have to <br />be relocated. <br />The City Planner reviewed his report dated December 11, <br />1990 recommending approval of the vacation. The <br />Planner reported that the alleyway serves no purpose <br />and the vacation would increase the buildable area of <br />adjacent properties. The Planner reported that in most <br />instances when property is vacated it is divided <br />equally among the adjacent properties. Therefore, in <br />this instance adjacent properties may each receive an <br />additional 10 feet. <br />Mr. Pat Vitali asked how the vacation would effect <br />setbacks on his property. <br />The City Planner explained that if the Vitali property <br />received 10 feet due to the vacation, this increases <br />the buildable area of the Vitali property since the <br />setback would be moved over an additional 10 feet. <br />Vitali stated that he would support the vacation if his <br />property received an additional 10 feet which resulted <br />in more buildable area for his lot. <br />It was noted for the record that Dick Boss III, owner <br />of Lots 4 and 5, Boss 2nd Addition, opposes the <br />vacation. <br />Rich Boss, resident of the area, stated that he, too, <br />was opposed. Boss was concerned that the additional <br />property would cause his property taxes to increase. <br />Boss also stated that the alleyway easement serves as a <br />buffer zone for his property. <br />The Planner stated that typically the County looks at <br />property values in determine property taxes. The <br />Planner also suggested that the City and County would <br />prefer to see any right -of -way that serves no purpose <br />back on tax rolls. The Planner pointed out the <br />potential liability issues to the City. The Planner <br />stated that when property is vacated, it typically goes <br />back to the property that gave it initially. <br />Rich Boss reported that his brother, Todd Boss, signed <br />the petition stating that he is in favor of the <br />vacation.
