ANALYSIS <br />Lot Split. As previously mentioned, the parcel is zoned R -1.. <br />The minimum lot requirements are as follows: <br />Lot Area <br />Lot Width <br />Setbacks: <br />Front Yard <br />Side Yard <br />R -1 <br />10,000 s.f. <br />75 feet <br />30 feet <br />5 feet for houses existing prior <br />to June 1981. <br />30 feet abutting a thoroughfare <br />Rear Yard 30 feet <br />The newly created lot will have 99.7 feet of road frontage on <br />LaBore Road and will exceed 10,000 square feet in area. All <br />minimum requirements have been met regarding lot size for the new <br />lot. The existing lot will now access Payne Avenue. Sixteen <br />additional feet is being acquired from the neighboring property <br />along Payne Avenue so the existing lot will contain the required <br />75 feet road frontage. All other minimum lot sizes standards <br />have been met. <br />Variance. By splitting the lot, the existing defined yards will <br />be changed. Currently, the front yard is along LaBore Road. <br />Side yards exist on the property lines running north -south and <br />rear yards exist on property lines running east -west. The <br />current house conforms to all setbacks except the rear yard. The <br />survey is drawn to show the house only 28 feet from the farthest <br />rear property line. The Ordinance requires 30 feet. <br />The lot split proposal would shift the front yard to Payne <br />Avenue. The side yards would run east -west and the rear yards <br />would run north - south. With this yard reconfiguration, the <br />existing house would then become non - conforming in that it would <br />only be five feet from the rear property line instead of the <br />required 30 feet. <br />A variance from the rear yard setback requirement will therefore <br />be required as part of this lot split request. <br />2 <br />Page 33 <br />
