MINUTES <br />PLANNING COMMISSION <br />JULY 12, 1990 <br />fencing must meet requirements for pools on public <br />safety. Also, the City is imposing a double -fee on <br />Poolside for their actions in constructing the display <br />before appropriate permits had been obtained. <br />Griebler stated that he would like to see the City <br />require that the Poolside property be fenced with a <br />six -foot fence. Griebler expressed concern about the <br />condition of the property in the back and the lack of <br />maintenance of this area by Poolside. <br />Anderson replied that in the past some of his neighbors <br />have opposed the fencing of the Poolside property. <br />Drabik asked if the gazebo was constructed without a <br />permit. <br />The Planner replied that it was, however, the <br />application before the Commission this evening would <br />include the gazebo. The Planner also pointed out that <br />the B -3 zoning of the property does not provide for <br />outdoor storage and the materials should be stored <br />inside. <br />Anderson replied that Poolside is attempting to get rid <br />of their storage. <br />Griebler stated that the existing enclosure is too <br />small for the amount of storage Poolside has. Griebler <br />was also concerned that Poolside does not cut the grass <br />in the back of their property and the dirt that was <br />excavated for the pool is sitting in that area as well. <br />Anderson replied that landscaping of the pool area had <br />been slowed down because of recent rains. <br />Drabik stated that the applicant should have been in <br />for his permit before the pool was constructed. At <br />that time she would have said no permit until the <br />property is cleaned up. <br />The Planner reported that the applicant can be required <br />to post security for the clean up in an amount equal to <br />the Building Inspector's estimate for cost of clean up. <br />Anderson stated that he did not think he needed a <br />permit to display a product that he sells. <br />Mr. Herkenhoff recommended approval of the Conditional <br />Use Permit for outdoor sales displays as requested by <br />Poolside, 121 East County Road C, contingent upon <br />Page 10 <br />
