6. The provisions of Section 921.010, C of this Ordinance are <br />considered and satisfactorily met. <br />Allowable Lot Coverage. Poolside, Inc. has submitted a site plan <br />for their new facility and parking layout in November 1984. It <br />was noted at that time that the site had existing accessory <br />building square footage in excess of the 30% of the square <br />footage of the principal building as allowed by the Ordinance. <br />This situation was remedied by requiring the applicant to remove <br />two existing buildings and leave the existing storage garage as a <br />nonconformity. No further construction of accessory buildings <br />could occur until such time as the principal structure was <br />expanded sufficiently to allow compliance with the 30 percent <br />regulation. <br />The outside sales area can, however, be addressed exclusive of <br />the accessory building requirements. As such, the accessory <br />building situation need not affect consideration of this request. <br />The issue will be whether or not the pool structure falls within <br />the allowable 30% requirement. This should also include the <br />gazebo structure which appears to have been added to the site <br />without formal approvals. By our calculations, the pool and <br />gazebo area cover approximately 1,500 square feet, equal to 26 <br />percent of the floor area of the principal building. <br />Setbacks. Setbacks in a B -3 zone are as follows: <br />1. Front yard: Not less than forty (40) feet. <br />2. Side yards: <br />a. Abutting residential property or public right-of-way - <br />40 feet. <br />b. Abutting nonresidential property - none <br />3. Rear yards: Not less than twenty (20) feet. <br />The setbacks corresponding to this lot would be no less than 40 <br />feet from County Road C and Jackson Street, 20 feet from the <br />northern property line and no required setback from the eastern <br />property line. <br />Based on the measurements shown on the submitted graphic, we have <br />superimposed the pool area plan onto the previously approved site <br />plan. It appears that the pool is setback approximately 55 feet <br />from the west property line and as such, meets all setback <br />requirements. <br />Other Issues. Since the original site plan approval was granted, <br />several changes have taken place on the site which were not part <br />of that review. In addition to the pool construction, the <br />gazebo was mentioned above.
