Our concerns over this request- involve two primary issues. <br />First, the City should consider precedent such a proposal may <br />establish. There remain some areas of the City where homes are <br />located on large parcels where similar requests are possible. <br />Examples would include Allan Avenue and Desoto Avenue and the <br />east portion of the City along LaBore. The second concern <br />involves maintenance and possible liability of private driveway <br />improvements on public right -of -way. If this request were to be <br />approved, a development contract should be required releasing the <br />City from the responsibility in these areas. <br />SUMMARY <br />The lot split is in full compliance with the dimensioned <br />standards of the Ordinance and can be recommended with full City <br />street improvements. The variance from the latter requirement, <br />however, is a policy issue. Topography and soils can be <br />sufficient rationale for variance approval, however, the extent <br />to which they apply in this case is unclear. We would caution <br />the City to exercise care in approving such a variance with any <br />consideration to include, at minimum, the development contract, <br />and City Engineer review of area conditions regarding topography, <br />soils, drainage, and the utility easements. <br />cc: Joel Hanson <br />Kathy Glanzer <br />Tom Sweeney <br />Mike Lynch <br />John Palacio <br />Tom Stewart <br />Page 28 <br />
