Mayor Fahey and Members of the City Council
August 17, 1990
Page 2
relative to this project. Slumberland has already
deposited $5,000 with the City to cover these
costs.
The advantages of this relationship are that the City does
not have to incur the cost for the construction of the
watermain and seek reimbursement, the City does not have to
complete 429 proceedings as Slumberland is paying 100% of
the costs (This condition could change due to the three
lots that could gain water service from this project), this
method allows for faster construction of the improvement to
meet Slumberland's time schedule, and the City retains
control over the installation of the watermain.
Mike Lynch is putting his survey crews on the project to
verify location of the Desoto Street right -of -way relative
to the oak tree. Based on this information, we will
determine if any easements are needed or if other
methodologies exist to allow us to install the watermain
without risking damage to the tree. We have also made
arrangements for the issuance of a footings permit subject
to the installation of the watermain and subject to the
developer's agreement whereby the developer can proceed at
his own risk until these documents are executed and a full
building permit is issued.
As stated earlier, the full document will be available for
your review at Wednesday's meeting. Should you have any
comments or questions in the meantime, please do not
hesitate to contact me.
JRH:kpv
Page 67
