AUG -21 -1990 08:18 FROM SWEENEY & BORER <br />TO LITTLE- CANADR P.03 /10 <br />DEVELOPMENT CONTRACT <br />AGREEMENT, dated , 19 , by and between <br />the CITY OF LITTLE CANADA, a Minnesota municipal corporation <br />( "City ") and K & L ASSOCIATES of Little Canada, a Minnesota <br />General Partnership, ( "Developer "). <br />1. Request for Improvement. The Developer has requested <br />the City to allow the construction of an extension of the <br />municipal water main within the Desoto Street right -of -way, <br />north of Alien Avenue, within the City of Little Canada to serve <br />the property of the developer, which is legally described as <br />follows: <br />That part of the South 528 feet of the North 1327.26 feet <br />of the Northwest Quarter of the Northwest Quarter of <br />Section 5, Township 29, Range 22, Ramsey County, Minnesota, <br />lying Easterly of the following described line: <br />Commencing at the Northeast corner of said South 528 <br />feet of the North 1327.26 feet of the Northwest <br />Quarter of the Northwest Quarter; thence North 88 <br />degrees 59 minutes 23 seconds West, assumed bearing, <br />along the North line of said South 528 feet, a <br />distance of 469.40 feet to the beginning of said <br />line; thence South 0 degrees 59 minutes 30 seconds <br />West, 528.00 feet, more or less, to the South line of <br />said South 528.00 feet and there terminating. <br />Except that portion taken for State Highway purposes. <br />The water main improvement is necessary to provide fire <br />protection for the construction of a proposed warehouse, located <br />East of the existing Slumberland building, as indicated on the <br />attached Exhibit A. The Developer has also requested the <br />necessary building permits for construction of the proposed <br />Page 10 <br />
