The City hereby approves the <br />extension of the water main within the Desoto Street <br />right -of -way, north of Allen Avenue, by the Developer, on <br />condition that the Developer enter into this Agreement and <br />guarantee compliance with the terms of this Agreement. The City <br />agrees to issue the necessary building permits to the Developer <br />for construction of the proposed warehouse upon execution of <br />this Agreement by the Developer. <br />3. Compliance with Laws and Regulations. The Developer <br />represents to the City that to the best of his knowledge the <br />extension of the water main will comply with all city, county, <br />metropolitan, state and federal laws and regulations, including, <br />but not limited to, subdivision ordinances, zoning ordinances <br />and environmental regulations. <br />4. Development Exhibits. The Developer shall develop the <br />proposed warehouse in accordance with Exhibit A, attached <br />hereto, and on file in the offices of the City. <br />5. Required Improvements. The Developer shall install, at <br />his own expense, the extension of water main within the Desoto <br />Street right -of -way, north of Allen Avenue, subject to approval <br />of this extension by the Minnesota Department of Health. The <br />City Engineer shall design the water main extension in <br />accordance with City specifications. The City must approve the <br />contractor who will install the water main extension.
