(2) Tree Removal in the Structure Setback Area: <br />In the Structure Setback Area of each lot, there shall be no removal <br />of trees having a diameter of 4 inches or more at a height of 4 feet <br />above the ground without the prior written consent of the City <br />unless the tree is dead, diseased or hazardous to the lot, an adjoining <br />lot, or to the traffic on the public access road or unless the removal <br />of the tree is necessary to build a driveway to the public access road. <br />(3) Tree Removal in the Building Area: <br />In the Building Area of each lot (that portion of the lot exclusive of <br />the Structure Setback Area), no tree with a diameter of 8 inches or <br />more at 4 feet in height above the ground may be removed without <br />the prior written consent of the City unless the removal of the tree is <br />necessary to build the residence, garage, driveway, parking area or <br />other improvements on the lot in locations selected by the owner of <br />the lot unless the tree is dead, diseased, or hazardous to the lot, an <br />adjoining lot, or traffic on the public access road <br />(3) Driveway Width: <br />No driveway may be more than 12 feet in width as it passes through <br />the 20 feet of Front Setback that is closest to the public access road <br />nor greater than 30 feet in width at any location within the Front <br />Setback. <br />9A.070.
