ANALYSIS <br />Essential services, defined in this case as a transmitting and <br />receiving tower, is a permitted use in a B -W District, however, <br />an essential service tower in excess of the height restrictions <br />requires a conditional use permit. Also since a PUD is a <br />conditional use in a B -W District, the amendment to the PUD <br />requires a conditional use permit as well. As such, the <br />application for conditional use permit should recognize both <br />requirements. <br />Per Section 921 of the Zoning Ordinance, the Planning Commission <br />may recommend a conditional use permit upon the finding that the <br />requested use meets each of the following criteria: <br />1. The proposed action has been considered in relation to the <br />specific policies and provisions of and has been found to be <br />consistent with the official City Comprehensive Land Use <br />Plan. <br />The existing land use is predominantly business - industrial <br />uses. A large portion of this area is the existing Little <br />Canada Professional Park. Since essential services are a <br />permitted use in the B -W District, this application is <br />consistent with the Comprehensive Land Use Plan. <br />2. The proposed site is or will be compatible with present and <br />future land uses of the area <br />With the area zoned B -W and the Professional Park PUD <br />approved and Phase I in place, present and future land use <br />has been determined. Based on present land use, the <br />proposed tower and building will be compatible. <br />3. The proposed use conforms with all performance standards <br />contained herein. <br />Setbacks. The two structures meet required front and side <br />yard setback requirements. The equipment building is <br />proposed on the lot line between Lots 18 and 19, which is <br />allowed within a PUD. Distance between the new control <br />structure and the existing professional building exceeds the <br />required minimum distance. <br />Access. The tower and building will receive access from the <br />existing blacktop parking lot, which is part of the <br />Professional Park.
