RECOMMENDATION <br />The application for a cellular phone tower at this location has <br />satisfied the general performance conditions associated with a <br />conditional use permit with some suggestions and modifications. <br />The existing land use in and around the area suggests that the <br />tower would be compatible with its surroundings. Our office has <br />no opposition to the application or the location of the tower. <br />We do, however, recommend that the developer demonstrate that <br />this is the best location for the tower. <br />Should the City grant the conditional use permits for the tower <br />and PUD amendment, we recommend it be granted with the following <br />conditions: <br />1. That a legal lease agreement exists between the applicant <br />and the land owner, and the City Attorney review the <br />agreement. <br />2. The extended blacktop be only 24 feet wide (west to east) to <br />minimize parking problems. <br />3. Any grading and utility issues be reviewed by the City <br />Engineer. <br />4. A landscape plan be presented showing final treatment of <br />disturbed area. <br />5. The applicant address safety issues if tower is knocked <br />down. <br />6. Applicant apply for all accessory building permits. <br />7.
