Little Canada CUP Application 1 April 1991 Page 3 <br />the Little Canada Zoning Ordinance requires a conditional use permit for telephone <br />transmission facilities which exceed the height limits established in the district where <br />the facility is to be located. This section of the Ordinance also limits the maximum <br />height of such facilities to 200 feet. In this case, the height restriction in the B -W <br />District is 36 feet and the proposed tower would be 125 feet. <br />In addition, a portion of the area that USWNVG proposes to lease from MR, Mueller is <br />part of a larger parcel for which a PUD was approved some time ago. As a result, <br />we have been informed, by Mr. Grittman, that the PUD would have to amended to <br />accommodate the proposed cellular facility. According to Mr. Grittman, the process for <br />amending a PUD is the same as that for a conditional use permit and therefore the <br />issues related to each can be reviewed under the same application. <br />Local Zoning Requirements <br />Special Use Criteria <br />Section 921.010 C. in the Little Canada Zoning Ordinance addresses the criteria which <br />must be met before a conditional use permit is granted. Each finding is addressed <br />below: <br />The proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City <br />Comprehensive Land Use Plan. <br />The Land Use Guide Plan within the Comprehensive Plan for the city of Little <br />Canada designates the subject property for Industrial /Business use. The proposed <br />cellular telephone facility is consistent with industrial and business uses. In fact <br />this use can be said to be complementary to business and industrial uses since <br />many of the people who utilize cellular telephones do so for business purposes. <br />Policy 4, of the Comprehensive Land Use Plan, calls for the City to identify and <br />facilitate the development of activities complementary to existing industrial <br />activities within the City. In addition, policy 8 of the Plan suggests the City <br />should cooperate in the provision of public services for those industries within the <br />City. <br />The proposed site is or will be compatible with present and future land uses of <br />the area. <br />The property is in an area is that is intended for Business - Warehouse use. The site <br />itself has an office building on it. This building represents the first phase of an <br />office /warehouse PUD that was approved for lots 19, 20, and 21 of J.F. <br />Eisenmenger's Garden Lots. A copy of the site plan for this PUD, showing the <br />location of the proposed equipment building and tower, is included with this <br />application. The proposed cellular telephone facility would be located on the <br />very north end of lot 19. However, this lot has been altered from the original <br />plan as part of an agreement with MnDot in which Mr. Mueller has purchased <br />additional land from them adjacent to the north side of his existing property in <br />this area. As a result the proposed equipment building and self support tower <br />can be accommodated on the site without interfering with previously approved <br />development plans. <br />Page 49 <br />
