Little Canada CUP Application 1 April 1991 Page 4 <br />Lot 19 is bounded on the north and west by MnDot ROW for Highway 36. The <br />area between the proposed facility and Highway 36 has significant vegetation. <br />This vegetation will be preserved to the greatest extent possible when the facility is <br />installed. These trees will help screen the tower from the Highway. The <br />equipment building itself should be entirely screened from the highway due to this <br />vegetation and the location of a small knoll in this corner of the property. <br />The proposed facility would be situated approximately 255 feet north of County <br />Road B, which abuts the south side of lot 19. County Road B is the boundary <br />between Little Canada and Maplewood in this area. The land directly south of <br />County Road B from Mr. Mueller's property is located in Maplewood. This land is <br />currently vacant and is zoned for business commercial use. There is a Cub Foods <br />store slightly southwest of the Mueller property and the Hilltop Dental Clinic is <br />located approximately 300 feet east of lot 19 also on the south side County Road <br />B. Since Mr. Mueller owns lots 20, 21, and a portion of lot 22 the nearest <br />adjacent property to the east would be the single family home on the north side <br />of County Road B. The proposed antenna structure and equipment building will <br />located over 450 feet from this residence. The property that this single family <br />home is located on is zoned B -W business /warehouse. There is a mini storage <br />facility and a multi - tenant industrial building located to the east of the single <br />family residence. The location of the cellular telephone facility, as proposed on <br />the attached site plan, is compatible with the existing uses in the area. The use <br />is also compatible with the type of uses permitted in the B -W zoning district. <br />The proposed use conforms with all performance standards contained herein. <br />The site plan included with this application illustrates the proposed location and <br />appearance of the antenna structure and equipment building. The location of the <br />building and self support antenna structure meet the required setback from <br />Highway 36 and the side yard setback from lot 20. However, in order to avoid <br />intruding on the existing parking lot for the office building on the property, the <br />tower and equipment building have been located within 10 feet of the rear lot <br />line between lot 19 and lot 18. The rear yard setback within the B -W district <br />is 20 feet. Lot 18 is also owned by Mr. Mueller and the location of the facility <br />on the property has been approved by him. In addition, this property is part of <br />a PUD. Generally PUD zoning allows for some flexibility in the enforcement of <br />such standards as interior lot line setbacks. Other than this minor rear yard <br />setback situation and the height of the antenna structure the proposed facility <br />meets all of the performance standards in the ordinance. <br />The proposed use will not tend to or actually depreciate the area in which it is <br />proposed. <br />The proposed use is compatible with surrounding uses and should have no effect <br />on adjacent land values. Further, the existence of cellular telephone antennas <br />has been shown not to appreciably affect property values even in residential <br />areas. <br />Page 50 <br />
