Northwest Associated Consultants, Inc. <br />U R B A N P L A N N I N G • D E S I G N • M A R K E T R E S E A R C H <br />PLANNING REPORT <br />TO: Little Canada Planning Commission <br />FROM: Allan Hunting /Stephen Grittman <br />DATE: 5 August 1991 <br />RE: Little Canada - Carlson - Condit Street Vacation <br />FILE NO: 758.09 - 91.19 <br />BACKGROUND <br />Mr. Ronald Carlson is requesting vacation of that portion of <br />Condit Street that runs along the east side of Lot 10, Block 2 of <br />the Southern Slope Addition adjacent to 216 Burke Lane. Mr. <br />Carlson is requesting this vacation so that he may be able to <br />construct his house closer to Burke Lane, mostly for reasons of <br />elevation and the sewer line. <br />Mr. Carlson applied for and was granted a setback variance for <br />this lot in May 1987. Previous to that in 1986, Mr. Dukowitz had <br />applied for and was granted a setback variance on the same lot. <br />In 1985, the City Council considered and denied a request to <br />vacate this same portion of Condit Street. The Council's <br />decision was based upon the fact that at that time, this area of <br />the City was largely undeveloped and therefore, it would be <br />unwise to vacate a street which may be needed in the future. <br />ANALYSIS <br />When the Southern Slope Addition was developed, the 30 foot wide <br />right -of -way was dedicated by the developer, therefore, any <br />right -of -way vacated would go to Lot 10. <br />With the development of the water works easement into a <br />pedestrian trail, the Park Commission has received interest from <br />the Burke Lane neighborhood to have a direct access to the trail. <br />This direct access would come from the Condit right -of -way. Mr. <br />Carlson discussed the vacation issue with the Park Commission at <br />their June meeting to see what they may want for access to the <br />trail.
