via Condit Street is closer to Country Drive than they would <br />like, however, they would like to see at least a 15 foot easement <br />remain for pedestrian access. Mr. Carlson was in favor of this <br />as it would allow him to get his house 30 or 40 feet closer to <br />Burke Lane. <br />It appears from aerial photos that the west 15 feet of the right - <br />of -way, north of the subject lot, is used for access to lots in <br />the subdivision and to Mr. Gagne's lot adjacent to Mr. <br />Carlson's. Before the right -of -way would be vacated, it must be <br />determined if Mr. Gagne's driveway does access onto a portion of <br />the right -of -way. If it does, it must be determined how to <br />address this issue if the right -of -way is vacated. <br />RECOMMENDATION <br />If the City decides to vacate any portion of the Condit Street <br />right -of -way along Lot 10, our office would recommend that the <br />west 15 feet be vacated and that the remaining 15 feet be <br />retained for use as a pedestrian path to the water works trail, <br />as recommended by the Park Commission. <br />Also it must be determined if any of the access driveway to Mr. <br />Gagne's property lies on the west 15 feet of Condit Street.
