Opaque front yard fences are not typically desirable in the City <br />because they limit visibility for police and emergency vehicles <br />to the property. Due to the nature of the location of this <br />house and the surrounding land use, it is reasonable to allow Mr. <br />Marche some protection and privacy to his property via the <br />proposed fence. To aid access for emergency vehicles, it may be <br />appropriate to require a gate along the side or front yard. <br />RECOMMENDATION <br />Based on the preceding review, our office recommends approval of <br />a conditional use permit to allow the erection of a six foot high <br />opaque fence along the front and side yard of Mr. Marche's <br />property for privacy and protection of his property, contingent <br />upon the following: <br />1. The applicant must apply for a building permit for the fence <br />and must comply with the applicable requirements of Section <br />903.020..F. Fences in the City Zoning Ordinance. <br />2. The applicant be required to provide a gate opening large <br />enough for emergency vehicles.
