Section 903.020.F.9. does, however, provide for special fences to <br />be erected that differ in construction, height or length in any <br />zoning district by issuance of a conditional use permit. It <br />would be more appropriate for this application to proceed as a <br />conditional use permit application rather than a variance <br />request. This report shall review this application against CUP <br />criteria. <br />In reviewing this request, the Planning Commission shall consider <br />possible adverse effects to the proposed conditional use. Its <br />judgement shall be based upon (but not limited to) the following <br />factors: <br />1. The proposed action has been considered in relation to the <br />specific policies and provisions of and has been found to be <br />consistent with the official City Comprehensive Land Use <br />Plan. <br />The request is not changing the use of the land, only adding <br />an improvement to an existing condition. The request is not <br />inconsistent with the Comprehensive Land Use Plan. <br />2. The proposed site is or will be compatible with present and <br />future land uses of the area. <br />Even though the property is zoned B -W, the Land Use Plan <br />does not prohibit or suggest removal of existing residential <br />uses. This application again is not a change of use and <br />therefore is not inconsistent with future land uses in the <br />area. <br />3. The proposed use conforms with all performance standards <br />contained herein. <br />The proposed fence must comply with all applicable <br />requirements set forth in Section 903.020.F. Fences. As <br />proposed, the fence complies with locational requirements <br />set forth. The remaining requirements will be satisfied at <br />time of building permit application. <br />4. The proposed use will not tend to or actually depreciate the <br />area in which it is proposed. <br />The fence addition will not depreciate values in the area. <br />5. The proposed use can be accommodated with existing public <br />services and will not overburden the City's service <br />capacity. <br />This request has no effect on the City's service capacity. <br />2 <br />Page 20 <br />
