MINNESOTA 55101 -1479 <br />June 10, 1991 <br />SUBJECT: Possible Filling or Grading in a Wetland Adjacent to Gervais Lake, Sec. <br />5, T. 29 N., R. 22 W., Ramsey County, Minnesota <br />Yvonne Arcilla <br />2735 Chisholm Avenue <br />North St. Paul, Minnesota 55109 <br />We have reviewed your project. You wish to build a house just west of <br />Keller Parkway and Gervais Lake. As Joe Yanta of our staff explained, a small <br />amount of fill in the nearby wetland would be authorized by a nationwide <br />Department of the Army permit, provided you follow the enclosed conditions. <br />A map search and drive -by inspection revealed that the site appears to be <br />primarily an area of old fill. A small area of wetland (less than 10,000 square <br />feet) may survive in the back of the lot, although the entire lot may have been <br />converted to upland. If the work is completely on the previously filled and <br />converted area, no Department of the Army permit is necessary. In lieu of a more <br />detailed field inspection, we are assuming that a small amount of fill or grading <br />may encroach into the wetland and have issued this nationwide permit. <br />This determination covers only this project. If the project changes or <br />if you plan other work that may affect wetlands, you should contact us so that <br />the work does not violate Federal law. <br />This verification will remain valid until the nationwide permit is <br />modified, reissued, or revoked. The nationwide permits are scheduled to be <br />modified, reissued, or revoked before January 13, 1992. It is your <br />responsibility to remain informed about changes to the nationwide permits. We <br />will issue a public notice that announces the changes when they occur. <br />Furthermore, if you begin or are under contract to begin this project before the <br />date the nationwide permit is modified or revoked, you will have 12 months from <br />the date of the modification or revocation to complete the project under the <br />present terms and conditions of this nationwide permit. <br />It is your responsibility to insure that the work complies with the terms <br />of this letter and the enclosures. IT IS YOUR RESPONSIBILITY TO OBTAIN ALL <br />REQUIRED STATE AND LOCAL PERMITS AND APPROVALS BEFORE YOU PROCEED.
