MINNESOTA 55101 -1479 June 10, 1991 SUBJECT: Possible Filling or Grading in a Wetland Adjacent to Gervais Lake, Sec. 5, T. 29 N., R. 22 W., Ramsey County, Minnesota Yvonne Arcilla 2735 Chisholm Avenue North St. Paul, Minnesota 55109 We have reviewed your project. You wish to build a house just west of Keller Parkway and Gervais Lake. As Joe Yanta of our staff explained, a small amount of fill in the nearby wetland would be authorized by a nationwide Department of the Army permit, provided you follow the enclosed conditions. A map search and drive -by inspection revealed that the site appears to be primarily an area of old fill. A small area of wetland (less than 10,000 square feet) may survive in the back of the lot, although the entire lot may have been converted to upland. If the work is completely on the previously filled and converted area, no Department of the Army permit is necessary. In lieu of a more detailed field inspection, we are assuming that a small amount of fill or grading may encroach into the wetland and have issued this nationwide permit. This determination covers only this project. If the project changes or if you plan other work that may affect wetlands, you should contact us so that the work does not violate Federal law. This verification will remain valid until the nationwide permit is modified, reissued, or revoked. The nationwide permits are scheduled to be modified, reissued, or revoked before January 13, 1992. It is your responsibility to remain informed about changes to the nationwide permits. We will issue a public notice that announces the changes when they occur. Furthermore, if you begin or are under contract to begin this project before the date the nationwide permit is modified or revoked, you will have 12 months from the date of the modification or revocation to complete the project under the present terms and conditions of this nationwide permit. It is your responsibility to insure that the work complies with the terms of this letter and the enclosures.
