For all construction projects, the AGENCY shall erect a sign <br />to COUNTY specifications at the construction site, <br />identifying the source of funds. <br />19. REVERSION OF ASSETS <br />The AGENCY shall transfer to the COUNTY any CDBG funds on hand at <br />the time of expiration and any accounts receivable attributable <br />to the use of CDBG funds. Any real property under the AGENCY's <br />control that was acquired or improved in whole or in part with <br />CDBG funds in excess of $25,000 is either: k <br />(i) Used to meet one of the national objectives in 24 C.F.R. <br />§ 570.208 until five years after expiration of the <br />agreement, or such longer period of time as determined <br />appropriate by the county; or <br />(ii) Is disposed of in a manner which results in the COUNTY <br />being reimbursed in the amount of the current fair <br />market value of the property less any portion thereof <br />attributable to expenditures of non -CDBG funds fpr <br />acquisition of, or improvement to, the property. Such <br />reimbursement is not required after the period of time <br />specified in accordance with (i) above. <br />20. PROHIBITED USE OF EXCESSIVE FORCE <br />The AGENCY, if a unit of government, certifies by the execution <br />of this Agreement that it has adopted and is enforcing a policy <br />prohibiting the use of excessive force by law enforcement <br />agencies within its jurisdiction against any individuals engaged <br />in nonviolent civil rights demonstrations. (Pub. Law No. 101 -104, <br />§519). <br />21. LOBBYING PROHIBITION <br />The AGENCY certifies by the execution of this Agreement that it <br />has adopted and is enforcing the following as required by Pub. <br />Law No. 101 -121, §319: <br />1. No federal appropriated funds have been paid or will be <br />paid by, or on behalf of, the undersigned to any person <br />for influencing or attempting to influence an officer or <br />employee of any agency, a Member of Congress, an officer <br />or employee of Congress, or an employee of a Member of <br />Congress, in connection with the awarding of any federal <br />contract, the making of any federal grant, the making of <br />any federal loan, the entering into of any cooperative <br />agreement, and the extension, continuation, renewal, <br />amendment, or modification of any federal contract, <br />grant, loan, or cooperative agreement. <br />2. If any funds other than federal appropriated funds have <br />been paid or will be paid to any person for influencing <br />or attempting to influence an officer or employee of any <br />agency, a Member of Congress, an officer or employee of <br />-14- <br />Page 56 <br />
